Families of Late Danlami Drag Kaduna State Government, Two Others to Court Over Illegal Demolition of Property

authoritatively report that the families of the late Alhaji Hamid Danlami have filed a lawsuit against the Kaduna State Government, Kaduna State Urban Planning and Development Authority (KASUPDA), and the Commissioner of Justice and the Attorney General of the state in court over the alleged illegal demolition of their property. They assert that this act constitutes a violation of their right to property ownership and human rights, seeking judicial redress.
The case, titled ‘Dr. Ibrahim Abdulhamid Danlami Vs Kaduna State Government & 2 Others,' was scheduled for hearing on the 6th of March 2024. However, the proceedings were adjourned due to the absence of the judge and the defendants.
The ongoing case is being heard in the State High Court in Zaria under the jurisdiction of Justice Kabir Dabo. The initial trial, which the defendants failed to attend, was adjourned, and notice was served for them to appear on April 24, 2024, for the continuation of the proceedings.
On the rescheduled hearing date of Wednesday, April 24, 2024, the defendants were once again absent but submitted a letter to the court requesting another date. In response, Barrister Haruna Magashi and Barrister Ishak, representing the plaintiffs, argued that the case should proceed despite the absence of the defendants' legal representatives, asserting that they were well aware of the matter. The presiding judge accepted their plea and proceeded with the hearing based on the complaint filed before him.
Following the arguments presented, the court set May 23, 2024, as the date for delivering judgment in the case.
Barrister Yushau bin Shaikh, the lead counsel for the plaintiffs, confirmed this development, stating that the case is now awaiting a final decision from the judge.
Abubakar Hameed Danlami, a member of the affected family, emphasized their pursuit of justice, stating, “The destruction of our property was illegal and unjust. We seek compensation for the damages incurred as a result of the demolition, which was carried out without prior notice. We trust in the court to deliver justice in this matter.”
Recall that on Sunday, May 27, 2024, the Kaduna State Government, in collaboration with KASUPDA and security agencies, demolished the house belonging to the late Alhaji Hamid Danlami, situated in Babban Dodo, Zaria, Kaduna State.
