Supreme Court Reinstates Anyanwu as PDP National Secretary

The Supreme Court has overturned the judgment of the Enugu Court of Appeal, which on December 22, 2024, removed Senator Samuel Anyanwu from his position as the National Secretary of the People's Democratic Party (PDP).

A five-member panel led by Justice Uwani Abba-Aji ruled that both the Enugu State High Court and the Court of Appeal lacked jurisdiction over the case.

Delivering the lead judgment, Justice Jamilu Tukur stated that the lawsuit filed by Emmanuel Aniagwu pertained to internal party affairs, which courts have no authority to adjudicate.

The court further affirmed that Anyanwu’s candidacy in the Imo governorship election was duly endorsed by the PDP leadership, dismissing Aniagwu’s claims to the contrary.

Additionally, the court ruled that Aniagwu lacked the legal standing to file the case, as he failed to demonstrate any personal harm, labeling him an interloper.

The Supreme Court also noted that S.K.E. Ude-Okoye, the alleged beneficiary of the case, was not a party to the suit.

Consequently, the court nullified the case initially filed at the Enugu High Court due to lack of jurisdiction.
